Terms of Use

These Terms of Use constitute a legally binding agreement between you and The Nikol Market. By creating an account, posting a listing, or placing an order, you confirm that you have read, understood, and agree to these terms.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes by email.

You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you meet this requirement.

Account accuracy: You are responsible for providing accurate, current, and complete information when registering and maintaining your account. You must promptly update your information if it changes.

Account security: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at bolo@nikol.market if you suspect unauthorised access to your account.

Seller responsibilities: Sellers must accurately describe their products, including condition, quantity, and price. Sellers are solely responsible for fulfilling orders, handling disputes with buyers, and complying with all applicable laws regarding the sale of their products.

Buyer responsibilities: Buyers must provide accurate delivery and contact information when placing orders. Buyers are responsible for making payment directly to the seller using the payment details provided at checkout.

Payment: All transactions on the Platform are conducted directly between buyers and sellers via UPI or bank transfer. The Nikol Market does not process, hold, or guarantee any payments. Any payment disputes must be resolved between the buyer and seller.

You may not use the Platform to list, sell, or purchase illegal goods or services, including but not limited to counterfeit products, controlled substances, weapons, or stolen goods.

You may not engage in fraudulent activity, including misrepresenting products, creating fake reviews, impersonating other users, or submitting false payment references (UTRs).

You may not use the Platform to spam, harass, threaten, or abuse other users.

You may not attempt to circumvent the Platform by conducting transactions off-platform after initial contact through The Nikol Market, in a manner intended to avoid Platform fees or policies.

You may not scrape, crawl, or use automated tools to extract data from the Platform without our prior written consent.

You may not attempt to gain unauthorised access to any part of the Platform, its servers, or its databases.

Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to relevant authorities.

The Nikol Market name, logo, design, and all Platform content created by us (including text, graphics, and code) are the intellectual property of The Nikol Market and are protected under applicable Indian law.

User-generated content: By posting product listings, images, descriptions, or other content on the Platform, you grant The Nikol Market a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.

You represent that you own or have the right to use all content you post, and that it does not infringe the intellectual property rights of any third party.

You may not reproduce, distribute, or create derivative works from Platform content without our prior written permission.

The Nikol Market is a marketplace platform that facilitates connections between buyers and sellers. We are not a party to any transaction between users and do not guarantee the quality, safety, legality, or delivery of any product listed on the Platform.

To the maximum extent permitted by applicable law, The Nikol Market shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to losses arising from failed transactions, product defects, or payment disputes.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the subscription fees you paid to us in the three months preceding the claim.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Buyer-seller disputes: Disputes regarding orders, payments, or product quality are primarily between the buyer and seller. We encourage both parties to resolve disputes amicably. You may contact us at bolo@nikol.market for mediation assistance, but we are not obligated to intervene.

Platform disputes: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.

Governing law: These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019, without regard to conflict of law principles.

Subscriptions: Seller subscription fees are non-refundable once a plan is activated. Subscription plans are activated manually within 24 hours of UPI payment verification. If a payment is not verified within 48 hours, please contact us with your UTR reference.

Cashback: Nikol Plus cashback is credited automatically to your wallet upon order placement. Cashback is non-transferable, has no cash value, and can only be used as a credit on the Platform (feature subject to future implementation).

Account termination: We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or harms the Platform or its users, with or without prior notice.

Listing removal: We reserve the right to remove any listing that violates these Terms, applicable law, or our community standards, without prior notice.

Export eligibility: Export eligibility badges are granted at our discretion based on seller history and product suitability. The badge does not constitute a guarantee of export success or regulatory compliance.
